1. ACCEPTANCE AND ELIGIBILITY
By accessing the DTE Solutions Hub, Pulse, SetLogic, Fluff, or purchasing DTE-branded apparel, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use our services.
Eligibility: You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account or use our financial applications (including Pulse). By using our services, you represent and warrant that you meet this age requirement.
2. DIGITAL SERVICES
Our digital applications (Pulse, SetLogic, Fluff) provide behavioral analysis, telemetry tracking, and data visualizations. These services are provided "as-is" for informational purposes. While we prioritize data integrity, we do not guarantee the absolute accuracy, completeness, or timeliness of automated AI insights ("Nova").
3. NO PROFESSIONAL ADVICE
- Pulse: Provides behavioral financial insights. It is not regulated financial, investment, tax, or legal advice. Consult a certified financial planner or registered investment advisor for high-stakes capital decisions.
- SetLogic & Fluff: Provide fitness, metabolic, and biomechanic analysis. They are not medical, physical therapy, or healthcare advice. Consult a licensed physician before beginning any new physical or training protocol.
4. SUBSCRIPTIONS, BILLING, AND AUTOMATIC RENEWAL
Pulse AI offers subscription-based access to our advanced behavioral telemetry features under the following terms:
- Subscription Pricing: Access is billed at a recurring rate of $14.99 per month, billed at the start of each billing cycle.
- Free Trial: New subscribers may receive a 7-day free trial week. Conversion to Paid: If you do not cancel the subscription before the 7-day trial period expires, your payment method on file will be automatically charged $14.99 on the 8th day, and your account will convert to a paid monthly subscription.
- Automatic Renewal: To ensure uninterrupted service, your subscription automatically renews every month on the anniversary of your billing date. Your designated payment method will be charged the recurring fee of $14.99/month until you cancel.
- Cancellation Rights: You may cancel your subscription at any time. To cancel, navigate to the Billing Portal within the Pulse application or email our support desk at support@dte-solutions.icu. Cancellation must be requested at least 24 hours prior to the next renewal date to prevent charges. Following cancellation, you will retain access until the end of your current paid billing period.
- Refund Policy: All subscription fees are non-refundable. We do not provide prorated refunds or credits for partially used billing cycles, except as explicitly required by law.
5. E-COMMERCE & MERCHANDISE
Physical merchandise (apparel, accessories) is sold via TikTok Shop and Etsy and fulfilled by Printify. By purchasing, you agree to the following:
- Shipping: Handled by our third-party fulfillment partners. Delivery times are estimates only.
- Returns & Refunds: Since items are custom-printed upon order, returns are only accepted for defective products or printing errors. Contact support within 14 days of receipt for resolution.
- Payments: All transactions are processed via secure checkout channels integrated with TikTok Shop or Etsy.
6. INTELLECTUAL PROPERTY
The DTE Solutions name, logos (Blackbglogo, PulseNova), software architecture, UI designs, and underlying codebases are the exclusive property of Drew Ernst, sole proprietor, doing business as DTE Solutions.. Unauthorized replication, modification, or reverse-engineering of our behavioral logic engines is strictly prohibited.
7. LIMITATION OF LIABILITY AND CARVE-OUTS
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Drew Ernst, sole proprietor, doing business as DTE Solutions., ITS OWNER, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE IN QUESTION DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Exclusions: Nothing in these terms is intended to exclude or limit liability for death, personal injury caused by our gross negligence, fraud, willful misconduct, or any other liability that cannot be lawfully excluded or limited under applicable state or local consumer protection laws.
8. MODIFICATIONS TO TERMS AND SERVICE
We reserve the right to modify these terms. For material changes that impact your subscription pricing, billing, or core usage rights, we will provide at least 30 days' advance notice via the email address associated with your account or through a prominent notice inside the applications. Your continued use of the services after the 30-day notice period constitutes acceptance of the modified terms.
9. DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
- Informal Resolution: In the event of a dispute, you agree to first contact us at support@dte-solutions.icu and attempt to resolve the issue informally before initiating any legal action.
- Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these terms or services that cannot be resolved informally shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association (AAA). The arbitration shall take place in Quincy, Illinois, or may be conducted virtually by mutual agreement.
- Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE THE RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER IN ANY CLASS ACTION.
- Venue & Jurisdiction: To the extent any dispute is permitted to be resolved in court, you and Drew Ernst, sole proprietor, doing business as DTE Solutions. agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Adams County, Illinois.
10. GOVERNING LAW
These terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law principles.
